Article L1424-89 of the French General Code of Local Authorities

The Saint-Barthélemy fire brigade is made up of:

1° Professional fire brigades;

2° Volunteer fire brigades.

Professional fire brigades, including the service manager, are recruited and managed by the collectivity, within the framework of the legislative and regulatory provisions applicable to them.

By way of derogation from the fourth paragraph, professional fire brigade officers may, under conditions laid down by regulation, be appointed to their grades, posts or functions jointly by the representative of the State in Saint-Barthélemy and the president of the territorial council.

Volunteer fire brigade members of the Saint-Barthélemy fire brigade are hired and managed by the collectivity, within the framework of the legislative and regulatory provisions that apply to them.

By way of derogation from the sixth paragraph, volunteer fire brigade officers and non-commissioned officers may, under conditions set by regulation, be appointed to their grades or duties jointly by the representative of the State in Saint-Barthélemy and the president of the territorial council.

For the application of the fourth to seventh paragraphs, the functions entrusted to the board of directors, its chairman and the departmental director of fire and rescue services are carried out respectively by the territorial council, the chairman of the territorial council and the head of the service.

All volunteer firefighters benefit from initial and ongoing training. The costs of training volunteer firefighters constitute compulsory expenditure for the collectivity of Saint-Barthélemy.

In the event of operational difficulties, the Saint-Barthélemy fire brigade may be dissolved by order of the minister responsible for civil security, made on the proposal of the representative of the State in Saint-Barthélemy, after consultation with the president of the territorial council and the minister responsible for overseas France. This order specifies the conditions for the reorganisation of the corps and the arrangements required to ensure rescue services until this reorganisation.

Le corps des sapeurs-pompiers de Saint-Barthélemy est composé :

1° Des sapeurs-pompiers professionnels ;

2° Des sapeurs-pompiers volontaires.

Les sapeurs-pompiers professionnels, dont le responsable du service, sont recrutés et gérés par la collectivité, dans le cadre des dispositions législatives et réglementaires qui leur sont applicables.

Par dérogation au quatrième alinéa, les officiers de sapeurs-pompiers professionnels peuvent, dans des conditions fixées par voie réglementaire, être nommés dans leurs grades, emplois ou fonctions conjointement par le représentant de l’Etat à Saint-Barthélemy et le président du conseil territorial.

Les sapeurs-pompiers volontaires membres du corps des sapeurs-pompiers de Saint-Barthélemy sont engagés et gérés par la collectivité, dans le cadre des dispositions législatives et réglementaires qui leur sont applicables.

Par dérogation au sixième alinéa, les officiers et les sous-officiers de sapeurs-pompiers volontaires peuvent, dans des conditions fixées par voie réglementaire, être nommés dans leurs grades ou fonctions conjointement par le représentant de l’Etat à Saint-Barthélemy et le président du conseil territorial.

Pour l’application des quatrième à septième alinéas, les fonctions confiées au conseil d’administration, à son président et au directeur départemental des services d’incendie et de secours sont assurées respectivement par le conseil territorial, le président du conseil territorial et le responsable du service.

Tout sapeur-pompier volontaire bénéficie d’une formation initiale et continue. Les frais de formation des sapeurs-pompiers volontaires constituent des dépenses obligatoires pour la collectivité de Saint-Barthélemy.

En cas de difficultés de fonctionnement, le corps des sapeurs-pompiers de Saint-Barthélemy peut être dissous par arrêté du ministre chargé de la sécurité civile, pris sur proposition du représentant de l’Etat à Saint-Barthélemy, après avis du président du conseil territorial et du ministre chargé de l’outre-mer. Cet arrêté précise les conditions de réorganisation du corps et les dispositions nécessaires pour assurer les secours jusqu’à cette réorganisation.
