Article L1431-2 of the French General Code of Local Authorities

The creation of a public establishment for cultural or environmental cooperation may only take place at the request of all the territorial authorities or groupings concerned, expressed by concordant deliberations of their councils or their deliberative bodies.

It is decided by order of the State representative in the region or department in which the establishment has its headquarters.

The articles of association of the public establishment, approved by all the public bodies involved in its creation, are appended to this order.

Article L1431-2

La création d’un établissement public de coopération culturelle ou environnementale ne peut intervenir qu’à la demande de l’ensemble des collectivités territoriales ou des groupements intéressés, exprimée par des délibérations concordantes de leurs conseils ou de leurs organes délibérants.

Elle est décidée par arrêté du représentant de l’Etat dans la région ou le département siège de l’établissement.

Les statuts de l’établissement public, approuvés par l’ensemble des personnes publiques participant à sa constitution, sont annexés à cet arrêté.
