Article L1435-10 of the French Public Health Code

The national guidelines for the fund are determined by the national steering committee for the regional health agencies.

The regional distribution of appropriations is set each year by order of the ministers responsible for health, the budget, social security, the elderly and the disabled, after receiving the opinion of the national steering committee of the regional health agencies.

The fund’s appropriations, delegated to the regional health agencies, are managed within the framework of the annexed budget mentioned in article L. 1432-5. The payment of expenditure from the budgets attached to the regional health agencies may be entrusted, by order of the ministers responsible for health, the budget and social security, to a body responsible for managing a compulsory health insurance scheme when the sums are paid directly to healthcare professionals.

Appropriations not used up at the end of the financial year may be carried over to the following year, up to a ceiling set by order of the ministers responsible for social security and health. The sums notified by the regional health agencies in respect of a financial year for actions, experiments and structures financed by the fund’s appropriations are prescribed on 31 December of the third financial year following that in which they were notified. Unused appropriations that are not carried over to the following financial year and appropriations corresponding to the sums notified and prescribed are taken into account when calculating the amount of appropriations allocated the following year under the regional intervention fund set by the order mentioned in the second paragraph of this article.

In order to monitor the use of the funds allocated to the Regional Intervention Fund, the Minister for Health is informed of the implementation of the supplementary budgets, in accordance with the conditions laid down by decree. A report on the implementation of the budgets and accounts for the previous year, drawn up on the basis of data supplied by each regional health agency, is sent to Parliament before 15 October each year.

This report includes in particular a presentation of:

1° Changes in the amount of regional funding allocated to the fund and the distribution criteria used, in particular with regard to the objective of equalisation between regions;

2° At national level and by region, the funding allocated to actions, experiments and structures contributing to the missions mentioned in article L. 1435-8 and the objectives thus achieved;

3° The evaluation procedures implemented to improve the allocation of funding through the fund, particularly with regard to experiments.

Les orientations nationales du fonds sont déterminées par le conseil national de pilotage des agences régionales de santé.

La répartition régionale des crédits est fixée chaque année par arrêté des ministres chargés de la santé, du budget, de la sécurité sociale, des personnes âgées et des personnes handicapées, après avis du conseil national de pilotage des agences régionales de santé.

Les crédits du fonds, délégués aux agences régionales de santé, sont gérés dans le cadre du budget annexe mentionné à l’article L. 1432-5. Le paiement des dépenses des budgets annexes des agences régionales de santé peut être confié, par arrêté des ministres chargés de la santé, du budget et de la sécurité sociale, à un organisme chargé de la gestion d’un régime obligatoire de l’assurance maladie lorsque les sommes sont directement versées aux professionnels de santé.

Les crédits des budgets annexes non consommés en fin d’exercice peuvent être reportés sur l’exercice suivant, dans la limite d’un plafond fixé par arrêté des ministres chargés de la sécurité sociale et de la santé. Les sommes notifiées par les agences régionales de santé au titre d’un exercice pour des actions, expérimentations et structures financées par les crédits du fonds sont prescrites au 31 décembre du troisième exercice suivant celui de leur notification. Les crédits non consommés qui ne sont pas reportés sur l’exercice suivant et les crédits correspondant aux sommes notifiées prescrites sont pris en compte pour le calcul du montant des crédits attribués l’année suivante au titre du fonds d’intervention régional fixé par l’arrêté mentionné au deuxième alinéa du présent article.

En vue d’assurer un suivi de l’utilisation des dotations affectées au fonds d’intervention régional, le ministre chargé de la santé est informé de l’exécution des budgets annexes, dans des conditions fixées par décret. Un bilan de l’exécution des budgets et des comptes de l’année précédente, élaboré sur la base des données transmises par chaque agence régionale de santé, est adressé au Parlement avant le 15 octobre de chaque année.

Ce bilan contient notamment une présentation :

1° De l’évolution du montant des dotations régionales affectées au fonds et des critères de répartition employés, notamment au regard de l’objectif de péréquation entre régions ;

2° A l’échelon national et par région, des financements alloués aux actions, expérimentations et structures concourant aux missions mentionnées à l’article L. 1435-8 et des objectifs ainsi atteints ;

3° Des démarches d’évaluation mises en œuvre pour améliorer l’allocation des financements par l’intermédiaire du fonds, notamment s’agissant des expérimentations.
