I. – Subject to articles L. 1511-3, L. 1511-7 and L. 1511-8, Title V of Book II of Part Two and Title III of Book II of Part Three, the Regional Council alone is competent to define aid schemes and to decide on the granting of aid to businesses in the region. Within the framework of an agreement signed with the region, the Lyon metropolitan area, the municipalities and their groupings may participate in the financing of aid and aid schemes set up by the region.
This aid takes the form of services, subsidies, interest subsidies, loans and repayable advances, at zero interest or on terms more favourable than market terms.
The Regional Council may delegate the granting of all or part of the aid to the metropolitan area of Lyon, the municipalities and their groupings, under the conditions set out in article L. 1111-8. It may delegate the management of all or part of the aid to public establishments or to the company mentioned in article 6 of order no. 2005-722 of 29 June 2005 relating to the Public Investment Bank. In cases where this company acts in the name and on behalf of the region, the payment and collection operations it carries out are carried out under the conditions provided for in I of Article L. 1611-7-2 of this code.
Aid granted on the basis of this I is intended for the creation or expansion of economic activities.
II. – When the protection of the economic and social interests of the population so requires, the Regional Council may grant aid to companies in difficulty. The terms of payment of the aid and the measures taken in return will be the subject of an agreement between the region and the company. In the event of the business resuming operations or returning to better fortunes, the agreement may provide for all or part of the regional aid to be reimbursed. The Lyon metropolitan area, the municipalities and their groupings may participate in the financing of the aid under an agreement signed with the region.
