Article L1511-3 of the French General Code of Local Authorities

In compliance with article L. 4251-17, the municipalities, the Lyon metropolitan area and the public establishments for inter-municipal cooperation with their own tax status are solely competent to define aid or aid schemes and decide on the granting of such aid within their territory in relation to business property investment and the leasing of land or buildings.

This aid takes the form of grants, discounts on the sale price, rental or hire purchase of bare or developed land or new or renovated buildings, loans, repayable advances or leasing on terms more favourable than those on the market. The amount of aid is calculated by reference to market conditions, in accordance with ceiling and zone rules laid down by regulation. This aid gives rise to the drawing up of an agreement and is paid either directly to the beneficiary company or to the project owner, whether public or private, who then passes on the benefit in full to the company.

The region may participate in the financing of the aid and aid schemes mentioned in the first paragraph of this article under conditions specified by an agreement signed with the commune, the Lyon metropolis or the public establishment for inter-communal cooperation with its own tax status.

The municipalities or public establishments for inter-municipal cooperation with their own tax status may, by means of an agreement with the département, delegate to it the power to grant all or part of the aid mentioned in this article.

Fees payable by beneficiaries of loan guarantees granted by credit institutions or finance companies may be paid, in full or in part, under conditions set by decree by the Conseil d’Etat. This aid cannot be combined, for the same loan, with the guarantee or surety granted by a local authority or grouping.

Aid granted on the basis of this article is intended for the creation or expansion of economic activities.

Dans le respect de l’article L. 4251-17, les communes, la métropole de Lyon et les établissements publics de coopération intercommunale à fiscalité propre sont seuls compétents pour définir les aides ou les régimes d’aides et décider de l’octroi de ces aides sur leur territoire en matière d’investissement immobilier des entreprises et de location de terrains ou d’immeubles.

Ces aides revêtent la forme de subventions, de rabais sur le prix de vente, de location ou de location-vente de terrains nus ou aménagés ou de bâtiments neufs ou rénovés, de prêts, d’avances remboursables ou de crédit-bail à des conditions plus favorables que celles du marché. Le montant des aides est calculé par référence aux conditions du marché, selon des règles de plafond et de zone déterminées par voie réglementaire. Ces aides donnent lieu à l’établissement d’une convention et sont versées soit directement à l’entreprise bénéficiaire, soit au maître d’ouvrage, public ou privé, qui en fait alors bénéficier intégralement l’entreprise.

La région peut participer au financement des aides et des régimes d’aides mentionnés au premier alinéa du présent article dans des conditions précisées par une convention passée avec la commune, la métropole de Lyon ou l’établissement public de coopération intercommunale à fiscalité propre.

Les communes ou les établissements publics de coopération intercommunale à fiscalité propre peuvent, par voie de convention passée avec le département, lui déléguer la compétence d’octroi de tout ou partie des aides mentionnées au présent article.

Les commissions dues par les bénéficiaires de garanties d’emprunt accordées par les établissements de crédit ou les sociétés de financement peuvent être prises en charge, totalement ou partiellement, dans des conditions fixées par décret en Conseil d’Etat. Cette aide ne peut pas être cumulée, pour un même emprunt, avec la garantie ou le cautionnement accordé par une collectivité ou un groupement.

Les aides accordées sur le fondement du présent article ont pour objet la création ou l’extension d’activités économiques.
