For its application in New Caledonia and French Polynesia, Article L. 1142-3 is replaced by the following provisions:
Art.L. 1142-3. – Where the promoter is not liable, victims may be compensated by the Office national d’indemnisation des accidents médicaux, des affections iatrogènes et des infections nosocomiales, in accordance with the provisions of article L. 1142-1 as it applies in New Caledonia and French Polynesia.
To assert their rights, victims apply to the conciliation and compensation commission for victims of medical accidents, iatrogenic conditions and nosocomial infections referred to in article L. 1142-5, whose territorial jurisdiction is determined by order of the Minister for Health.
