Article L1614-10 of the French General Code of Local Authorities

The appropriations previously included in the State budget for the construction, equipment and operation of municipal and inter-municipal libraries and the equipment of departmental libraries are the subject of a special contribution within the general decentralisation grant. They are distributed by the State representative between the départements, communes and groups of local authorities carrying out investment work and non-permanent operating expenditure in respect of the powers they exercise by virtue of articles L. 310-1 and L. 330-1 of the Heritage Code.

The State’s financial contribution under the special assistance relating to municipal and inter-municipal libraries and departmental libraries provided for in the first paragraph must not have the effect of having all or part of the current operating expenses mainly grouping together staff remuneration costs, maintenance expenses and miscellaneous operating expenses corresponding to the authority’s remit, with the exception of those granted in the following two situations:

1° Initial, non-renewable aid granted when carrying out an operation;

2° Initial aid granted for a project to extend or change library opening hours.

A decree in the Conseil d’Etat sets the conditions for the application of this article, in particular those governing the financing of projects to extend or change library opening hours mentioned in 2°. These conditions of application are adapted as necessary to the overseas departments.

Les crédits précédemment inscrits au budget de l’Etat au titre de la construction, de l’équipement et du fonctionnement des bibliothèques municipales et intercommunales et de l’équipement des bibliothèques départementales font l’objet d’un concours particulier au sein de la dotation générale de décentralisation. Ils sont répartis par le représentant de l’Etat entre les départements, les communes et les groupements de collectivités territoriales réalisant des travaux d’investissements et des dépenses de fonctionnement non pérennes au titre des compétences qu’ils exercent en vertu des articles L. 310-1 et L. 330-1 du code du patrimoine.

La participation financière de l’Etat au titre du concours particulier relatif aux bibliothèques municipales et intercommunales et aux bibliothèques départementales prévu au premier alinéa ne doit pas avoir pour effet de faire prendre en charge tout ou partie des dépenses de fonctionnement courant regroupant principalement les frais de rémunération des personnels, les dépenses d’entretien et les frais de fonctionnement divers correspondant aux compétences de la collectivité, hormis celles accordées dans les deux situations suivantes :

1° L’aide initiale et non renouvelable accordée lors de la réalisation d’une opération ;

2° L’aide initiale accordée pour un projet d’extension ou d’évolution des horaires d’ouverture de bibliothèques.

Un décret en Conseil d’Etat fixe les conditions d’application du présent article, notamment celles encadrant le financement des projets d’extension ou d’évolution des horaires d’ouverture de bibliothèques mentionnés au 2°. Ces conditions d’application sont adaptées en tant que de besoin, aux départements d’outre-mer.
