Article L1872-1 of the French General Code of Local Authorities

I. – Article L. 1612-1, with the exception of its last paragraph, the articles L. 1612-2 to L. 1612-11, l’article L. 1612-12, the articles L. 1612-13 to L. 1612-15, L. 1612-16 to L. 1612-19-1 and the I of Article L. 1612-20 shall apply to the communes of French Polynesia subject to the adaptations provided for in II to V.

II. – These articles come into force in the communes of French Polynesia under the conditions provided for by II of Article 7 of Ordinance No. 2007-1434 of 5 October 2007 extending Parts One, Two and Five of the General Code of Territorial Authorities to the communes of French Polynesia, their groupings and their public establishments, with the exception of Article L. 1612-3 which comes into force immediately.

III. – For the application of Article L. 1612-5, the words: “in Articles L. 2131-1, L. 3131-1 and L. 4141-1” are replaced by the words: “in Article L. 2131-1”.

IV. – For the application of Article L. 1612-7, the words: “as from the 1997 financial year” are deleted.

V. – For the application of article L. 1612-16, the words: “, the president of the departmental council or the president of the regional council as the case may be,” are deleted.

Article L1872-1

I. – L’article L. 1612-1, à l’exception de son dernier alinéa, les articles L. 1612-2 à L. 1612-11, l’article L. 1612-12, les articles L. 1612-13 à L. 1612-15, L. 1612-16 à L. 1612-19-1 et le I de l’article L. 1612-20 sont applicables aux communes de la Polynésie française sous réserve des adaptations prévues aux II à V.

II. – Ces articles entrent en vigueur dans les communes de Polynésie française dans les conditions prévues par le II de l’article 7 de l’ordonnance n° 2007-1434 du 5 octobre 2007 portant extension des première, deuxième et cinquième parties du code général des collectivités territoriales aux communes de la Polynésie française, à leurs groupements et à leurs établissements publics, à l’exception de l’article L. 1612-3 qui entre en vigueur immédiatement.

III. – Pour l’application de l’article L. 1612-5, les mots : ” aux articles L. 2131-1, L. 3131-1 et L. 4141-1 ” sont remplacés par les mots : ” à l’article L. 2131-1 “.

IV. – Pour l’application de l’article L. 1612-7, les mots : ” à compter de l’exercice 1997 ” sont supprimés.

V. – Pour l’application de l’article L. 1612-16, les mots : “, le président du conseil départemental ou le président du conseil régional suivant le cas, ” sont supprimés.
