Article L2112-3 of the French General Code of Local Authorities

If the project concerns the detachment of a section of a commune or a portion of the territory of a commune, either to attach it to another commune or to erect it as a separate commune, a decree by the State representative in the département establishes, for this section or portion of territory, a commission that gives its opinion on the project.

The number of members of the commission is set by this decree.

The members of the commission, chosen from among those eligible to sit on the municipal council of the commune, are elected according to the same rules as municipal councillors in communes with fewer than 2,500 inhabitants.

Where they are registered on the commune’s electoral roll, the following are eligible to vote: inhabitants with a real and fixed domicile within the territory of the section or portion of territory and owners of property located within this section or portion of territory.

The commission elects its chairman from among its members.

Si le projet concerne le détachement d’une section de commune ou d’une portion du territoire d’une commune, soit pour la rattacher à une autre commune, soit pour l’ériger en commune séparée, un arrêté du représentant de l’Etat dans le département institue, pour cette section ou cette portion de territoire, une commission qui donne son avis sur le projet.

Le nombre des membres de la commission est fixé par cet arrêté.

Les membres de la commission, choisis parmi les personnes éligibles au conseil municipal de la commune, sont élus selon les mêmes règles que les conseillers municipaux des communes de moins de 2 500 habitants.

Sont électeurs, lorsqu’ils sont inscrits sur les listes électorales de la commune, les habitants ayant un domicile réel et fixe sur le territoire de la section ou de la portion de territoire et les propriétaires de biens fonciers sis sur cette section ou portion de territoire.

La commission élit en son sein son président.
