If the project concerns the detachment of a section of a commune or a portion of the territory of a commune, either to attach it to another commune or to erect it as a separate commune, a decree by the State representative in the département establishes, for this section or portion of territory, a commission that gives its opinion on the project.
The number of members of the commission is set by this decree.
The members of the commission, chosen from among those eligible to sit on the municipal council of the commune, are elected according to the same rules as municipal councillors in communes with fewer than 2,500 inhabitants.
Where they are registered on the commune’s electoral roll, the following are eligible to vote: inhabitants with a real and fixed domicile within the territory of the section or portion of territory and owners of property located within this section or portion of territory.
The commission elects its chairman from among its members.
