The performance conditions relating to the works, supplies or services which are the subject of the contract, in any respect whatsoever and at any stage of their life cycle, are deemed to be linked to the subject of the contract. In particular, they may relate to a specific production, supply or marketing process or to a specific process linked to another stage of the life cycle, even when these elements are not apparent from the intrinsic qualities of the works, supplies or services.
The life cycle is the set of successive or interdependent stages, including research and development to be carried out, production, marketing and its conditions, transport, use and maintenance, throughout the life of the product, work or service, from the acquisition of raw materials or the production of resources to disposal, restoration and the end of use of the product, work or service.

Les conditions d’exécution qui se rapportent aux travaux, fournitures ou services objet du marché, à quelque égard que ce soit et à n’importe quel stade de leur cycle de vie sont réputées liées à l’objet du marché. Elles peuvent notamment se rapporter à un processus spécifique de production, de fourniture ou de commercialisation ou à un processus spécifique lié à un autre stade du cycle de vie, même lorsque ces éléments ne ressortent pas des qualités intrinsèques des travaux, fournitures ou services.
Le cycle de vie est l’ensemble des étapes successives ou interdépendantes, y compris la recherche et le développement à réaliser, la production, la commercialisation et ses conditions, le transport, l’utilisation et la maintenance, tout au long de la vie du produit, de l’ouvrage ou du service, depuis l’acquisition des matières premières ou la production des ressources jusqu’à l’élimination, la remise en état et la fin de l’utilisation du produit, de l’ouvrage ou la fin du service.
