Article L2112-5 of the French General Code of Local Authorities

Subject to the provisions of articles L. 3112-1 and L. 3112-2 concerning the boundaries of the départements, decisions relating to the modification of the territorial boundaries of the communes and the fixing or transfer of chief towns resulting or not from this modification are pronounced by order of the representative of the State in the département.

However, a decree in the Council of State, on the proposal of the Minister of the Interior, is required when the proposed territorial modification has the effect of affecting the cantonal boundaries.

Sous réserve des dispositions des articles L. 3112-1 et L. 3112-2 concernant les limites des départements, les décisions relatives à la modification des limites territoriales des communes et à la fixation ou au transfert de chefs-lieux résultant ou non de cette modification sont prononcées par arrêté du représentant de l’Etat dans le département.

Toutefois, un décret en Conseil d’Etat, sur la proposition du ministre de l’intérieur, est requis lorsque la modification territoriale projetée a pour effet de porter atteinte aux limites cantonales.
