Article L212-14 of the French Intellectual Property Code

I.-The provision of a phonogram in such a way that anyone can access it on their own initiative, in the context of streaming, is subject to a minimum remuneration guarantee.

II.The terms and conditions of the minimum remuneration guarantee provided for in I and its level are established by one or more specific agreements concluded between, on the one hand, the professional organisations representing performers and the collective management bodies mentioned in Title II of Book III of this Part representing performers and, on the other hand, the professional organisations representing phonogram producers and the collective management bodies mentioned in Title II of Book III of this Part representing phonogram producers.

This agreement or these agreements may be made binding on all the performers and phonogram producers concerned by order of the minister responsible for culture.

III.In the event that the specific agreement(s) do not specify the terms and level of the minimum remuneration guarantee provided for in I for all or some of the performers, within twelve months of the promulgation of Order no. 2021-580 of 12 May 2021, these terms and conditions and this level are determined for the performers concerned by a commission chaired by a representative of the State and composed, in addition, half of persons appointed by the organisations representing performers and half of persons appointed by the organisations representing phonogram producers. The level of the guaranteed minimum remuneration is determined by the commission in such a way as to involve performers appropriately in the exploitation of phonograms.

IV.-The minimum remuneration guarantee provided for in I is proportional to the economic value of the rights under the conditions set out in II of article L. 212-3. It may, however, also be fixed on a flat-rate basis in the cases provided for in that same article.

V.-A decree of the Council of Ministers is to be issued for the purpose of guaranteeing the economic value of the rights.
V.-A Conseil d’Etat decree sets out the operating procedures for the commission referred to in III.

Article L212-14

I.-La mise à disposition d’un phonogramme de manière que chacun puisse y avoir accès de sa propre initiative, dans le cadre des diffusions en flux, fait l’objet d’une garantie de rémunération minimale.

II.-Les modalités de la garantie de rémunération minimale prévue au I et son niveau sont établis par un ou plusieurs accords spécifiques conclus entre, d’une part, les organisations professionnelles représentatives des artistes-interprètes et les organismes de gestion collective mentionnés au titre II du livre III de la présente partie représentant les artistes-interprètes et, d’autre part, les organisations professionnelles représentatives des producteurs de phonogrammes et les organismes de gestion collective mentionnés au titre II du livre III de la présente partie représentant les producteurs de phonogrammes.

Ce ou ces accords peuvent être rendus obligatoires à l’ensemble des artistes-interprètes et des producteurs de phonogrammes concernés par arrêté du ministre chargé de la culture.

III.-Dans l’hypothèse où le ou les accords spécifiques ne précisent pas les modalités et le niveau de la garantie de rémunération minimale prévue au I pour tout ou partie des artistes-interprètes, dans un délai de douze mois à compter de la promulgation de l’ordonnance n° 2021-580 du 12 mai 2021, ces modalités et ce niveau sont déterminés pour les artistes-interprètes concernés par une commission présidée par un représentant de l’Etat et composée, en outre, pour moitié, de personnes désignées par les organisations représentant les artistes-interprètes et, pour moitié, de personnes désignées par les organisations représentant les producteurs de phonogrammes. Le niveau de la garantie de rémunération minimale est déterminé par la commission de manière à associer justement les artistes-interprètes à l’exploitation des phonogrammes.

IV.-La garantie de rémunération minimale prévue au I est proportionnelle à la valeur économique des droits dans les conditions prévues au II de l’article L. 212-3. Elle peut toutefois aussi être fixée forfaitairement dans les cas prévus dans ce même article.

V.-Un décret en Conseil d’Etat fixe les modalités de fonctionnement de la commission mentionnée au III.
