Article L2121-2-1 of the French General Code of Local Authorities

The same applies in communes with 100 to 499 inhabitants, if the municipal council has at least nine members following the second round of the general renewal of the municipal council or a supplementary election.
The same applies in municipalities with a population of between 100 and 499, provided that the municipal council has at least nine members following the second round of the general renewal of the municipal council or a by-election.

Where the first two paragraphs of this article are applied and for the application of all the legal provisions relating to the number of members of the municipal council, this number is equal to the number of members of the municipal council at the end of the last election, whether it is a general renewal or a supplementary election.

However, for the application of article L. 284 of the electoral code, the municipal councils of the communes mentioned in the first two paragraphs of this article elect a delegate.

Article L2121-2-1

Par dérogation à l’article L. 2121-2, dans les communes de moins de 100 habitants, le conseil municipal est réputé complet dès lors que le conseil municipal compte au moins cinq membres à l’issue du second tour du renouvellement général du conseil municipal ou d’une élection complémentaire.

Il en va de même dans les communes de 100 à 499 habitants, dès lors que le conseil municipal compte au moins neuf membres à l’issue du second tour du renouvellement général du conseil municipal ou d’une élection complémentaire.

Lorsqu’il est fait application des deux premiers alinéas du présent article et pour l’application de toutes les dispositions légales relatives à l’effectif du conseil municipal, cet effectif est égal au nombre de membres que compte le conseil municipal à l’issue de la dernière élection, qu’il s’agisse d’un renouvellement général ou d’une élection complémentaire.

Toutefois, pour l’application de l’article L. 284 du code électoral, les conseils municipaux des communes mentionnées aux deux premiers alinéas du présent article élisent un délégué.
