Article L2123-25-1 of the French General Code of Local Authorities

When an elected official who receives an official allowance and who has not interrupted any professional activity cannot effectively carry out his duties in the event of illness, maternity, paternity or accident, the amount of the official allowance paid to him is at most equal to the difference between the allowance previously allocated to him and the daily allowances paid by his social protection scheme.

The conditions for the application of this article are laid down by decree.

Lorsqu’un élu qui perçoit une indemnité de fonction et qui n’a pas interrompu toute activité professionnelle ne peut exercer effectivement ses fonctions en cas de maladie, maternité, paternité ou accident, le montant de l’indemnité de fonction qui lui est versée est au plus égal à la différence entre l’indemnité qui lui était allouée antérieurement et les indemnités journalières versées par son régime de protection sociale.

Les conditions d’application du présent article sont fixées par décret.
