Article L214-71 of the French Monetary and Financial Code

Subject to the provisions of articles L. 214-45 and L. 214-77, a real estate investment trust (fonds de placement immobilier), which does not have legal personality, is a co-ownership vehicle made up of real estate assets, financial instruments and other assets as defined in article L. 214-36, the units of which are issued and redeemed at the request of unitholders at the net asset value plus or minus fees and commissions, as applicable, in accordance with the conditions set out in the general regulations of the Autorité des marchés financiers.

The provisions of the Civil Code relating to joint ownership and those of articles 1871 to 1873 of the same Code relating to joint ventures do not apply to the real estate investment fund.

Sous réserve des dispositions des articles L. 214-45 et L. 214-77, le fonds de placement immobilier, qui n’a pas la personnalité morale, est une copropriété composée d’actifs immobiliers, d’instruments financiers et autres actifs tels que définis à l’article L. 214-36, dont les parts sont, dans les conditions fixées par le règlement général de l’Autorité des marchés financiers, émises et rachetées à la demande des porteurs à la valeur liquidative majorée ou diminuée, selon le cas, des frais et commissions.

Ne s’appliquent pas au fonds de placement immobilier les dispositions du code civil relatives à l’indivision ni celles des articles 1871 à 1873 du même code relatives aux sociétés en participation.
