Article L2141-7-1 of the French Public procurement code

The purchaser may exclude from the procedure for the award of a contract persons subject to Article L. 225-102-4 of the French Commercial Code who do not comply with the obligation to draw up a due diligence plan including the measures provided for in the same Article L. 225-102-4, for the year preceding the year of publication of the invitation to tender or the launch of the consultation. Such consideration may not be such as to restrict competition or make it technically or economically difficult to perform the service.

L’acheteur peut exclure de la procédure de passation d’un marché les personnes soumises à l’article L. 225-102-4 du code de commerce qui ne satisfont pas à l’obligation d’établir un plan de vigilance comportant les mesures prévues au même article L. 225-102-4, pour l’année qui précède l’année de publication de l’avis d’appel à la concurrence ou d’engagement de la consultation. Une telle prise en compte ne peut être de nature à restreindre la concurrence ou à rendre techniquement ou économiquement difficile l’exécution de la prestation.
