Article L2141-7 of the French Public procurement code

The purchaser may exclude from the contract award procedure persons who, during the previous three years, have been required to pay damages, have had their contract terminated or have been subject to a comparable sanction as a result of a serious or persistent breach of their contractual obligations during the performance of a previous public procurement contract.

L’acheteur peut exclure de la procédure de passation d’un marché les personnes qui, au cours des trois années précédentes, ont dû verser des dommages et intérêts, ont été sanctionnées par une résiliation ou ont fait l’objet d’une sanction comparable du fait d’un manquement grave ou persistant à leurs obligations contractuelles lors de l’exécution d’un contrat de la commande publique antérieur.
