Article L2152-2 of the French Labour Code

The following professional employers’ organisations are representative at national and multi-sector level:

1° Which meet the criteria mentioned in 1° to 5° of article L. 2151-1 ;

2° Which are representative or whose member organisations are representative on the basis of article L. 2152-1 of this code in at least ten collective agreements relating either to the agricultural activities mentioned in 1° to 4° of article L. 722-1 and in 2° of article L. 722-20 of the rural and maritime fishing code, or to the social and solidarity economy, or to the live and recorded performance sector, and not falling within the field covered by the representative professional employers’ organisations at national and cross-industry level;

3° To which at least fifteen organisations from one of the three fields of activity mentioned in 2° of this article belong;

4° Which have a territorial coverage of at least one third of the national territory either at departmental or regional level.

Article L2152-2

Sont représentatives au niveau national et multi-professionnel les organisations professionnelles d’employeurs :

1° Qui satisfont aux critères mentionnés aux 1° à 5° de l’article L. 2151-1 ;

2° Qui sont représentatives ou dont les organisations adhérentes sont représentatives sur le fondement de l’article L. 2152-1 du présent code dans au moins dix conventions collectives relevant soit des activités agricoles mentionnées aux 1° à 4° de l’article L. 722-1 et au 2° de l’article L. 722-20 du code rural et de la pêche maritime, soit de l’économie sociale et solidaire, soit du secteur du spectacle vivant et enregistré, et ne relevant pas du champ couvert par les organisations professionnelles d’employeurs représentatives au niveau national et interprofessionnel ;

3° Auxquelles adhèrent au moins quinze organisations relevant de l’un des trois champs d’activités mentionnés au 2° du présent article ;

4° Qui justifient d’une implantation territoriale couvrant au moins un tiers du territoire national soit au niveau départemental, soit au niveau régional.
