The forced sale of the assets takes place by public auction after a period of one month from the date of the seizure, during which the debtor may proceed to an amicable sale under the conditions provided for in this article.
The debtor against whom a compulsory execution measure is being pursued may, under the conditions laid down by decree of the Conseil d’Etat, voluntarily sell the seized assets in order to allocate the price to the payment of creditors.
The debtor shall inform the enforcement agent of the proposals made to him. If the creditor establishes that these proposals are insufficient, the person in charge of enforcement proceeds with the removal of the asset(s) so that they can be sold at public auction.
The creditor cannot be held liable unless the refusal to authorise the sale was motivated by an intention to harm the debtor.
Transfer of ownership of the property is subject to payment of the price.
