Article L2214-1 of the French General Code of Local Authorities

The State police system may be established in a commune according to its security needs. These needs are assessed with regard to the permanent and seasonal population, the location of the municipality within an urban area and the characteristics of crime.

It is established by joint order of the competent ministers when the request comes from the municipal council or, in the event of the latter’s agreement, by decree in the Council of State in the opposite case.

The abolition of the State police system in a municipality is carried out in the same manner and according to the same criteria.

A decree in the Council of State sets out the procedures for applying this article.

Article L2214-1

Le régime de la police d’Etat peut être établi dans une commune en fonction de ses besoins en matière de sécurité. Ces besoins s’apprécient au regard de la population permanente et saisonnière, de la situation de la commune dans un ensemble urbain et des caractéristiques de la délinquance.

Il est institué par arrêté conjoint des ministres compétents lorsque la demande émane du conseil municipal ou en cas d’accord de celui-ci, par décret en Conseil d’Etat dans le cas contraire.

La suppression du régime de la police d’Etat dans une commune est opérée dans les mêmes formes et selon les mêmes critères.

Un décret en Conseil d’Etat fixe les modalités d’application du présent article.
