Article L2215-5 of the French General Code of Local Authorities

Precarious or essentially revocable road permissions on public roads which are placed within the remit of the mayor and the purpose of which is, in particular, the establishment in the ground of the public road of pipes intended for the passage or conduct of water or gas may, in the event of refusal by the mayor not justified by the general interest, be granted by the representative of the State in the department.

Les permissions de voirie à titre précaire ou essentiellement révocable sur les voies publiques qui sont placées dans les attributions du maire et ayant pour objet, notamment, l’établissement dans le sol de la voie publique des canalisations destinées au passage ou à la conduite de l’eau ou du gaz peuvent, en cas de refus du maire non justifié par l’intérêt général, être accordées par le représentant de l’Etat dans le département.
