Communes and syndicates of communes may directly operate services of public interest of an industrial or commercial nature.

Operations likely to be managed by private companies, either by application of the law of 2-17 March 1791, or, with regard to the operation of communal public services, by virtue of concession or affermage contracts, are considered to be industrial or commercial.

Les communes et les syndicats de communes peuvent exploiter directement des services d’intérêt public à caractère industriel ou commercial.

Sont considérées comme industrielles ou commerciales les exploitations susceptibles d’être gérées par des entreprises privées, soit par application de la loi des 2-17 mars 1791, soit, en ce qui concerne l’exploitation des services publics communaux, en vertu des contrats de concession ou d’affermage.
