Article L2223-1 of the French General Code of Local Authorities

Each municipality or each public establishment for inter-municipal cooperation with jurisdiction over cemeteries has at least one cemetery comprising a plot dedicated to the burial of the dead and, in municipalities with 2,000 or more inhabitants or public establishments for inter-municipal cooperation with 2,000 or more inhabitants with jurisdiction over cemeteries, at least one cinerary site intended to receive the ashes of deceased persons whose body has given rise to cremation.

The creation, extension and relocation of a cemetery are decided by the municipal council. However, in urban communes and within the perimeters of built-up areas, the creation, enlargement and relocation of a cemetery less than 35 metres from dwellings are authorised by decree of the State representative in the department, issued after a public enquiry carried out in accordance with Chapter III of Title II of Book I of the Environment Code and the opinion of the competent departmental commission on the environment, health and technological risks.

A Conseil d’Etat decree sets out the conditions for application of this article.

Chaque commune ou chaque établissement public de coopération intercommunale compétent en matière de cimetières dispose d’au moins un cimetière comprenant un terrain consacré à l’inhumation des morts et, dans les communes de 2 000 habitants et plus ou les établissements publics de coopération intercommunale de 2 000 habitants et plus compétents en matière de cimetières, d’au moins un site cinéraire destiné à l’accueil des cendres des personnes décédées dont le corps a donné lieu à crémation.

La création, l’agrandissement et la translation d’un cimetière sont décidés par le conseil municipal. Toutefois, dans les communes urbaines et à l’intérieur des périmètres d’agglomération, la création, l’agrandissement et la translation d’un cimetière à moins de 35 mètres des habitations sont autorisés par arrêté du représentant de l’Etat dans le département, pris après une enquête publique réalisée conformément au chapitre III du titre II du livre Ier du code de l’environnement et avis de la commission départementale compétente en matière d’environnement, de risques sanitaires et technologiques.

Un décret en Conseil d’Etat fixe les conditions d’application du présent article.
