Article L2223-20 of the French General Code of Local Authorities

The national regulations governing funeral undertakers are established by decree in the Council of State after receiving the opinion of the National Council for Funeral Operations. They define the procedures for informing families and the obligations of the régies and companies or associations authorised to provide the services listed in Article L. 2223-19.

These regulations determine:

1° The conditions under which information is provided to families, in particular the information that must be included in quotations provided by service providers showing the mandatory services separately, and more generally the procedures for applying the regulatory texts adopted on the basis of Article L. 113-3 of the Consumer Code;

2° The conditions of application of the provisions of the Insurance Code to the funeral funding packages that may be offered;

3° The obligations of the régies and the authorised undertakings or associations in terms of the professional training of their managers and agents ;

4° The specific obligations relating to the management and use of funeral or mortuary chambers and crematoria;

5° The conditions for the intervention of persons likely to carry out the conservation care mentioned in 3° of Article L. 2223-19.

Article L2223-20

Le règlement national des pompes funèbres est établi par décret en Conseil d’Etat après avis du Conseil national des opérations funéraires. Il définit les modalités d’information des familles et les obligations des régies et des entreprises ou associations habilitées à fournir les prestations énumérées à l’article L. 2223-19.

Ce règlement détermine :

1° Les conditions dans lesquelles est assurée l’information des familles, en particulier les mentions que doivent comporter les devis fournis par les prestataires faisant apparaître de façon distincte les prestations obligatoires, et plus généralement les modalités d’application des textes réglementaires pris sur la base de l’article L. 113-3 du code de la consommation ;

2° Les conditions d’application des dispositions du code des assurances aux formules de financement en prévision d’obsèques qui peuvent être proposées ;

3° Les obligations des régies et des entreprises ou associations habilitées en matière de formation professionnelle de leurs dirigeants et de leurs agents ;

4° Les obligations particulières relatives à la gestion et à l’utilisation des chambres funéraires ou mortuaires et des crématoriums ;

5° Les conditions d’intervention des personnes susceptibles de réaliser les soins de conservation mentionnés au 3° de l’article L. 2223-19.
