Article L2223-34-1 of the French General Code of Local Authorities

Any clause in a contract providing for funeral services in advance without the detailed and personalised content of these services being defined is deemed unwritten.

Any contract providing for funeral services in advance shall specify the conditions for the allocation of technical and financial profits, in accordance with Article L. 132-5 of the Insurance Code. Each year, when it is positive, an amount is allocated to it corresponding to a share of the credit balance of the financial account, at least equal to 85% of this balance multiplied by the ratio between the mathematical provisions relating to this contract and the total mathematical provisions, less the interest credited to the mathematical provisions relating to this same contract during the financial year. It is also the subject of annual information in accordance with article L. 132-22 of the same code. An order specifies the methods for calculating and allocating this share.

Toute clause d’un contrat prévoyant des prestations d’obsèques à l’avance sans que le contenu détaillé et personnalisé de ces prestations soit défini est réputée non écrite.

Tout contrat prévoyant des prestations d’obsèques à l’avance précise les conditions d’affectation des bénéfices techniques et financiers, conformément à l’article L. 132-5 du code des assurances. Il lui est affecté chaque année, lorsqu’il est positif, un montant correspondant à une quote-part du solde créditeur du compte financier, au moins égale à 85 % de ce solde multiplié par le rapport entre les provisions mathématiques relatives à ce contrat et le total des provisions mathématiques, diminuée des intérêts crédités aux provisions mathématiques relatives à ce même contrat au cours de l’exercice. Il fait aussi l’objet d’une information annuelle conformément à l’article L. 132-22 du même code. Un arrêté précise les modalités de calcul et d’affectation de cette quote-part.
