In order to guarantee the contracting party or subscriber of a funeral services package in advance full and complete freedom of choice throughout his or her life, whether the contract is an individual contract or membership of a group contract within the meaning of Article L. 141-1 of the Insurance Code, the contract must explicitly provide for the option for the contracting party or the subscriber to change the nature of the funeral, the burial method, the content of the funeral services and supplies, the authorised operator appointed to carry out the funeral and, where applicable, the agent appointed to ensure that the wishes expressed within the meaning of Article 3 of the law of 15 November 1887 on the freedom of funerals, the change or changes made to equivalent supplies and services will entitle the holder to charge only the management fees provided for in the general terms and conditions subscribed to, subject to a fine of 15,000 euros per offence committed, in the event of failure by a company to respect this freedom to modify or to propose a contract that does not include this option.
