Article L2223-39 of the French General Code of Local Authorities

Public or private health establishments that meet the conditions laid down by decree in the Conseil d’Etat must have a mortuary in which the bodies of people who have died there must be deposited. However, the mortuary chamber may incidentally receive, for a fee, the bodies of persons who have died outside these establishments if there is no funeral chamber nearby.

The provisions of article L. 2223-38 do not apply to mortuary rooms.

Les établissements de santé publics ou privés qui remplissent des conditions fixées par décret en Conseil d’Etat doivent disposer d’une chambre mortuaire dans laquelle doit être déposé le corps des personnes qui y sont décédées. Toutefois, la chambre mortuaire peut accessoirement recevoir, à titre onéreux, les corps des personnes décédées hors de ces établissements en cas d’absence de chambre funéraire à sa proximité.

Les dispositions de l’article L. 2223-38 ne sont pas applicables aux chambres mortuaires.
