Article L2224-21 of the French General Code of Local Authorities

When it is found that a fair or market, even a simple supply market, constitutes a serious disturbance to general traffic because it is held on a site that is wholly or partly within the rights-of-way of a main road, the representative of the State in the département shall give formal notice to the municipality to move the fair or market to another location within one year of notification of this formal notice, or to limit the location by a specific line so as to eliminate any encroachment on the rights-of-way of the trunk road.

After the expiry of the one-year period, any installation or occupation of land that is made on the occasion of this fair or market and does not take account of the decision of the representative of the State in the department is automatically prohibited.

Article L2224-21

Lorsqu’il est constaté qu’une foire ou un marché, même de simple approvisionnement, constitue, en raison de sa tenue sur un emplacement compris en tout ou partie dans les emprises d’une route à grande circulation, une cause de trouble grave pour la circulation générale, le représentant de l’Etat dans le département met la commune en demeure de transférer, dans le délai d’un an à partir de la notification de cette mise en demeure, cette foire ou ce marché sur un autre emplacement, ou d’en limiter l’emplacement par une ligne déterminée de manière à supprimer tout empiétement sur les emprises de la route à grande circulation.

Après l’expiration du délai d’un an, est de plein droit interdite toute installation ou occupation de terrain qui est faite à l’occasion de cette foire ou de ce marché et ne tient pas compte de la décision du représentant de l’Etat dans le département.
