I. – Any abstraction, well or borehole drilled for domestic water use must be declared to the mayor of the municipality concerned. Companies must keep a register of water wells they drill, whatever their use, and must declare them on behalf of their customer to the mayor of the commune concerned within three months of their completion. The information relating to this declaration is made available to the representative of the State in the department, the director general of the regional health agency and the agents of the public drinking water and sanitation services.
The provision of work to create wells or boreholes for domestic water use referred to in the first paragraph and the provision of restoration work carried out when operating work ceases comply with the technical requirements of a certification issued under conditions laid down by decree in the Conseil d’Etat.
Without prejudice to any criminal proceedings that may be brought, where drilling work is carried out without having the certification issued in application of this article, the competent administrative authority may, in the cases and under the conditions laid down by decree in the Conseil d’Etat and without first issuing a formal notice, order the payment of an administrative fine. This administrative fine may not exceed €15,000 per work.
II. – Any system for using rainwater for domestic purposes inside a building supplied by a public or private water network intended for human consumption must first be declared to the mayor of the municipality concerned. Information relating to this declaration is made available to the representative of the State in the département and forwarded to the agents of the public drinking water and wastewater collection services.
The possibility of using rainwater to supply toilets, wash floors and wash laundry in residential buildings or similar is extended to establishments receiving the public. Such use is subject to prior declaration to the mayor of the municipality concerned.
III. – A decree in the Conseil d’Etat will define the terms and conditions for the application of this article.
