Article L2232-4 of the French Public procurement code

Works over which the holder has rights in rem or of which it is the owner may only be mortgaged with a view to guaranteeing loans taken out to finance the performance of its obligations under the partnership contract.
The contract constituting the mortgage must, on pain of nullity, be approved by the purchaser and, where applicable, by the person owning the estate.
Only mortgage creditors may exercise precautionary measures or enforcement measures over the property rights resulting from the contract.

Les ouvrages sur lesquels le titulaire dispose de droits réels ou dont il est propriétaire ne peuvent être hypothéqués qu’en vue de garantir des emprunts contractés pour financer la réalisation des obligations qu’il tient du marché de partenariat.
Le contrat constituant l’hypothèque doit, à peine de nullité, être approuvé par l’acheteur et, le cas échéant, par la personne propriétaire du domaine.
Seuls les créanciers hypothécaires peuvent exercer des mesures conservatoires ou des mesures d’exécution sur les droits immobiliers résultant du contrat.
