Article L2312-1 of the French General Code of Local Authorities

The municipal budget is proposed by the mayor and voted by the municipal council.

In municipalities of 3,500 inhabitants or more, the mayor presents to the municipal council, within a period of two months prior to the examination of the budget, a report on the budget guidelines, the multi-year commitments envisaged and the structure and management of the debt. This report gives rise to a debate at the Town Council, under the conditions set out in the rules of procedure provided for in article L. 2121-8. This debate is recorded in a specific resolution.

In municipalities with more than 10,000 inhabitants, the report mentioned in the second paragraph of this article also includes a presentation of the structure and development of expenditure and staff numbers. This report specifies, in particular, the forecast development and implementation of staff costs, remuneration, benefits in kind and working hours. It is sent to the representative of the State in the department and to the president of the public inter-municipal cooperation body of which the municipality is a member; it is published. The content of the report and the procedures for its transmission and publication are set by decree.

The provisions of this article apply to the public administrative establishments of communes of 3,500 inhabitants or more.

Le budget de la commune est proposé par le maire et voté par le conseil municipal.

Dans les communes de 3 500 habitants et plus, le maire présente au conseil municipal, dans un délai de deux mois précédant l’examen du budget, un rapport sur les orientations budgétaires, les engagements pluriannuels envisagés ainsi que sur la structure et la gestion de la dette. Ce rapport donne lieu à un débat au conseil municipal, dans les conditions fixées par le règlement intérieur prévu à l’article L. 2121-8. Il est pris acte de ce débat par une délibération spécifique.

Dans les communes de plus de 10 000 habitants, le rapport mentionné au deuxième alinéa du présent article comporte, en outre, une présentation de la structure et de l’évolution des dépenses et des effectifs. Ce rapport précise notamment l’évolution prévisionnelle et l’exécution des dépenses de personnel, des rémunérations, des avantages en nature et du temps de travail. Il est transmis au représentant de l’Etat dans le département et au président de l’établissement public de coopération intercommunale dont la commune est membre ; il fait l’objet d’une publication. Le contenu du rapport ainsi que les modalités de sa transmission et de sa publication sont fixés par décret.

Les dispositions du présent article s’appliquent aux établissements publics administratifs des communes de 3 500 habitants et plus.
