Article L2312-63 of the French Labour Code

When the Social and Economic Committee becomes aware of facts likely to have a worrying effect on the economic situation of the company, it may ask the employer to provide explanations.

This request is automatically included on the agenda for the next committee meeting.

If the committee is unable to obtain a satisfactory response from the employer, or if the employer confirms that the situation gives cause for concern, it will draw up a report. In undertakings employing at least one thousand employees and in the absence of an agreement as provided for in article L. 2315-45, this report is drawn up by the economic committee as provided for in article L. 2315-46.

This report, as part of the economic alert right, is sent to the employer and to the statutory auditor.

Lorsque le comité social et économique a connaissance de faits de nature à affecter de manière préoccupante la situation économique de l’entreprise, il peut demander à l’employeur de lui fournir des explications.


Cette demande est inscrite de droit à l’ordre du jour de la prochaine séance du comité.


Si le comité n’a pu obtenir de réponse suffisante de l’employeur ou si celle-ci confirme le caractère préoccupant de la situation, il établit un rapport. Dans les entreprises employant au moins mille salariés et en l’absence d’accord prévu à l’article L. 2315-45, ce rapport est établi par la commission économique prévue par l’article L. 2315-46.


Ce rapport, au titre du droit d’alerte économique, est transmis à l’employeur et au commissaire aux comptes.
