When there is a change in the legal situation of the employer as referred to in Article L. 1224-1, the mandate of the elected members of the staff delegation of the social and economic committee and of the trade union representatives of the undertaking which has been the subject of the change continues when this undertaking retains its legal autonomy.
If this undertaking becomes an establishment within the meaning of this title or if the modification mentioned in the first paragraph concerns one or more distinct establishments which retain this character, the mandate of the trade union representatives continues and the mandate of the elected members of the staff delegation of the social and economic committee continues until its end.
However, in order to take account of the usual date of elections in the host company, the term of office of the elected members may be reduced or extended by agreement between the new employer and the representative trade union organisations existing in the absorbed establishment(s) or, failing that, the members of the staff delegation of the social and economic committee concerned.
