Article L2316-8 of the French Labour Code

In each company, the distribution of seats between the different establishments and the different colleges is the subject of an agreement between the employer and the trade union organisations concerned, concluded under the conditions of article L. 2314-6.

In the event of disagreement on the distribution of seats, the administrative authority in whose jurisdiction the head office of the company is located decides on this distribution.

Referral to the administrative authority suspends the electoral process until the administrative decision is taken and extends the current terms of office of the elected representatives concerned until the results of the ballot are announced.

Even if the decision is taken before the term of office of certain members has expired, the determination of the number of separate establishments and the allocation of seats between establishments and the various categories are applied without having to wait for the normal renewal date of all or some of the delegations of the establishment social and economic committees.

The decision of the administrative authority may be appealed to the judicial judge, to the exclusion of any other administrative or contentious appeal.

Dans chaque entreprise, la répartition des sièges entre les différents établissements et les différents collèges fait l’objet d’un accord entre l’employeur et les organisations syndicales intéressées, conclu selon les conditions de l’article L. 2314-6.

En cas de désaccord sur la répartition des sièges, l’autorité administrative dans le ressort de laquelle se trouve le siège de l’entreprise décide de cette répartition.

La saisine de l’autorité administrative suspend le processus électoral jusqu’à la décision administrative et entraîne la prorogation des mandats en cours des élus concernés jusqu’à la proclamation des résultats du scrutin.

Même si elles interviennent alors que le mandat de certains membres n’est pas expiré, la détermination du nombre d’établissements distincts et la répartition des sièges entre les établissements et les différentes catégories sont appliquées sans qu’il y ait lieu d’attendre la date normale de renouvellement de toutes les délégations des comités sociaux et économiques d’établissement ou de certaines d’entre elles.

La décision de l’autorité administrative peut faire l’objet d’un recours devant le juge judiciaire, à l’exclusion de tout autre recours administratif ou contentieux.
