Article L2321-5 of the French General Code of Local Authorities

The communes whose inhabitants represent, in respect of one year, more than 1% of the parturients or more than 1% of the deceased in a public health establishment comprising a maternity unit and situated on the territory of another commune with less than 10,000 inhabitants contribute financially to the expenditure incurred by this other commune for the keeping of civil status records and the exercise of funeral policing acts if the ratio between the number of births recorded in this establishment and the population of the commune in which it is situated exceeds 30%.

The contribution of each municipality is fixed by applying to the expenditure referred to in the first paragraph the proportion that is due to the inhabitants who have their domicile on its territory in the total number of civil status records or, as the case may be, funeral policing records recorded in the municipality of establishment.

The contribution is due each year in respect of expenditure recorded in the previous year.

Failing agreement between the municipalities concerned on their respective contributions or the creation of a joint service responsible for exercising these powers, the contribution of each municipality is set by the State representative in the department of the headquarters of the public health establishment.

Les communes dont les habitants représentent, au titre d’une année, plus de 1 % des parturientes ou plus de 1 % des personnes décédées dans un établissement public de santé comportant une maternité et situé sur le territoire d’une autre commune comptant moins de 10 000 habitants contribuent financièrement aux dépenses exposées par cette autre commune pour la tenue de l’état civil et l’exercice des actes de police des funérailles si le rapport entre le nombre des naissances constatées dans cet établissement et la population de la commune d’implantation dépasse 30 %.

La contribution de chaque commune est fixée en appliquant aux dépenses visées au premier alinéa la proportion qui est due aux habitants qui ont leur domicile sur son territoire dans le nombre total d’actes d’état civil ou, selon le cas, de police des funérailles constaté dans la commune d’implantation.

La contribution est due chaque année au titre des dépenses constatées l’année précédente.

A défaut d’accord entre les communes concernées sur leurs contributions respectives ou de création d’un service commun chargé de l’exercice de ces compétences, la contribution de chaque commune est fixée par le représentant de l’Etat dans le département du siège de l’établissement public de santé.
