Article L2333-86 of the French General Code of Local Authorities

The fees referred to in article L. 2333-84 are subject to the five-year statute of limitations which begins to run from the date on which they became due.

The four-year limitation period instituted by the loi n° 68-1250 du 31 décembre 1968 relative à la prescription des créances sur l’Etat, les départements, les communes et les établissements publics is alone applicable to the action for restitution of royalties.

Les redevances visées à l’article L. 2333-84 sont soumises à la prescription quinquennale qui commence à courir à compter de la date à laquelle elles sont devenues exigibles.

La prescription quadriennale instituée par la loi n° 68-1250 du 31 décembre 1968 relative à la prescription des créances sur l’Etat, les départements, les communes et les établissements publics est seule applicable à l’action en restitution des redevances.
