Article L2335-1 of the French General Code of Local Authorities

I.-In order to provide them with the appropriate means to implement the provisions of Chapter III of Title II of Book I of this Part and to contribute to the democratisation of local mandates, small rural communes receive a special allocation taken from State revenues and determined each year according to the total population of these communes and their financial potential.

This special allocation changes each year according to the rate of change in the overall operating allocation. From 2011, this change does not apply.

In 2006, the amount of this allocation calculated in this way is increased by 10.5 million euros. From 2007, for the calculation of the deduction to be made from State revenues in respect of this allocation, the amount of the special allocation to be taken into account in respect of 2006, calculated in accordance with the conditions set out in the second paragraph, is increased by 10.5 million euros.

II.-.From 2023, the amount of the allocation mentioned in I is increased:

1° By 4.5 million euros in respect of the compensation mentioned in the second paragraph of article L. 2123-18-2;

2° By 3 million euros in respect of the compensation mentioned in the third paragraph of article L. 2123-34 and the last paragraph of article L. 2123-35.

By way of derogation from the first paragraph of I of this article, the amounts mentioned in 1° and 2° of this II are allocated to municipalities with fewer than 3,500 inhabitants on the basis of the population of these municipalities, according to a scale set by decree.

III.-.Individual allocations under this grant may be established by order of the Minister responsible for local and regional authorities published in the Journal officiel. This publication serves as notification to the local authorities.

A decree in the Conseil d’Etat sets out the terms and conditions for the application of this article.

I.-Pour leur assurer les moyens adaptés à la mise en oeuvre des dispositions du chapitre III du titre II du livre Ier de la présente partie et contribuer à la démocratisation des mandats locaux, les petites communes rurales reçoivent une dotation particulière prélevée sur les recettes de l’Etat et déterminée chaque année en fonction de la population totale de ces communes ainsi que de leur potentiel financier.

Cette dotation particulière évolue chaque année en fonction du taux d’évolution de la dotation globale de fonctionnement. A compter de 2011, cette évolution ne s’applique pas.

En 2006, le montant de cette dotation ainsi calculé est majoré de 10,5 millions d’euros. A compter de 2007, pour le calcul du prélèvement à effectuer sur les recettes de l’Etat au titre de cette dotation, le montant de la dotation particulière à prendre en compte au titre de 2006, calculé dans les conditions prévues au deuxième alinéa, est majoré de 10,5 millions d’euros.

II.-A compter de 2023, le montant de la dotation mentionnée au I est majoré :

1° De 4,5 millions d’euros au titre de la compensation mentionnée au deuxième alinéa de l’article L. 2123-18-2 ;

2° De 3 millions d’euros au titre des compensations mentionnées au troisième alinéa de l’article L. 2123-34 et au dernier alinéa de l’article L. 2123-35.

Par dérogation au premier alinéa du I du présent article, les montants mentionnés aux 1° et 2° du présent II sont attribués aux communes de moins de 3 500 habitants en fonction de la population de ces communes, selon un barème fixé par décret.

III.-Les attributions individuelles au titre de cette dotation peuvent être constatées par arrêté du ministre chargé des collectivités territoriales publié au Journal officiel. Cette publication vaut notification aux collectivités territoriales.

Un décret en Conseil d’Etat fixe les modalités d’application du présent article.
