Article L2341-3 of the French Labour Code

The provisions of this Title apply to

1° to a Community-scale undertaking or group of undertakings whose registered office or that of the parent undertaking is in France ;

2° To the Community-scale undertaking or group of undertakings whose registered office or that of the dominant undertaking is located in a State other than those mentioned in Article L. 2341-1 and which has appointed a representative in France for the application of the provisions of this Title;

3° A Community-scale undertaking or group of undertakings whose registered office or that of the dominant undertaking is located in a State other than those mentioned in Article L. 2341-1, which has not appointed a representative in any of these States and whose establishment or undertaking which employs the largest number of employees within these States is located in France.

Article L2341-3

Les dispositions du présent titre s’appliquent :

1° A l’entreprise ou au groupe d’entreprises de dimension communautaire dont le siège social ou celui de l’entreprise dominante est situé en France ;

2° A l’entreprise ou au groupe d’entreprises de dimension communautaire dont le siège social ou celui de l’entreprise dominante se trouve dans un Etat autre que ceux mentionnés à l’article L. 2341-1 et qui a désigné, pour l’application des dispositions du présent titre, un représentant en France ;

3° A l’entreprise ou au groupe d’entreprises de dimension communautaire dont le siège social ou celui de l’entreprise dominante se trouve dans un Etat autre que ceux mentionnés à l’article L. 2341-1, qui n’a pas procédé à la désignation d’un représentant dans aucun de ces Etats et dont l’établissement ou l’entreprise qui emploie le plus grand nombre de salariés au sein de ces Etats est situé en France.
