Article L2342-3 of the French Labour Code

The employer initiates the procedure for setting up the special negotiating body when the workforce referred to in article L. 2341-1 is reached on average over the previous two years.

The number of employees is calculated in accordance with the provisions of article L. 1111-2 for companies or establishments located in France and in accordance with national law in other countries.

The persons responsible for obtaining and transmitting to the employees and their representatives referred to in article L. 2342-4 the information essential to the opening of the negotiations referred to in article L. 2342-1, in particular information relating to the structure of the company or group and its workforce, are :

1° Any head of a company or of the dominant company in a Community-scale group of companies;

2° Any head of an undertaking belonging to a Community-scale group of undertakings;

3° Any head of an establishment of a Community-scale undertaking or belonging to a Community-scale group of undertakings;

4° In the absence of a representative in France designated in application of 2° of article L. 2341-3, the head of the establishment of the Community-scale undertaking or the head of the dominant undertaking of the Community-scale group of undertakings mentioned in 3° of this article.

Article L2342-3

L’employeur engage la procédure de constitution du groupe spécial de négociation lorsque les effectifs mentionnés à l’article L. 2341-1 sont atteints en moyenne sur l’ensemble des deux années précédentes.

Le calcul des effectifs s’effectue conformément aux dispositions de l’article L. 1111-2 pour les entreprises ou établissements situés en France et conformément au droit national dans les autres Etats.

Les responsables de l’obtention et de la transmission aux salariés et à leurs représentants mentionnés à l’article L. 2342-4 des informations indispensables à l’ouverture des négociations mentionnées à l’article L. 2342-1, notamment des informations relatives à la structure de l’entreprise ou du groupe et à ses effectifs, sont :

1° Tout chef d’une entreprise ou de l’entreprise dominante d’un groupe d’entreprises de dimension communautaire ;

2° Tout chef d’une entreprise appartenant à un groupe d’entreprises de dimension communautaire ;

3° Tout chef d’un établissement d’une entreprise de dimension communautaire ou appartenant à un groupe d’entreprises de dimension communautaire ;

4° En l’absence de représentant en France désigné en application du 2° de l’article L. 2341-3, le chef de l’établissement de l’entreprise de dimension communautaire ou le chef de l’entreprise dominante du groupe d’entreprises de dimension communautaire mentionnés au 3° de cet article.
