Article L2342-5 of the French Labour Code

The head of the undertaking or the head of the dominant undertaking in the Community-scale group of undertakings shall invite and convene the special negotiating body to a meeting.

He shall inform the heads of the establishments of the undertaking or the heads of the undertakings of the Community-scale group of undertakings and the European organisations of employees and employers consulted by the European Commission of the composition of the special negotiating body and of the start of the negotiations.

Before and after the meetings with the head of the undertaking or the head of the dominant undertaking of the Community-scale group of undertakings, the special negotiating body may meet, using the means necessary and appropriate for communication between its members, without the presence of the representatives of the head of the undertaking or the head of the dominant undertaking of the Community-scale group of undertakings.

Le chef de l’entreprise ou de l’entreprise dominante du groupe d’entreprises de dimension communautaire invite et convoque le groupe spécial de négociation à une réunion.

Il informe de la composition du groupe spécial de négociation et du début des négociations les chefs des établissements de l’entreprise ou les chefs des entreprises du groupe d’entreprises de dimension communautaire et les organisations européennes de salariés et d’employeurs consultées par la Commission européenne.

Avant et après les réunions avec le chef de l’entreprise ou de l’entreprise dominante du groupe d’entreprises de dimension communautaire, le groupe spécial de négociation peut se réunir, avec les moyens nécessaires et adaptés à la communication entre ses membres, hors la présence des représentants du chef de l’entreprise ou de l’entreprise dominante du groupe d’entreprises de dimension communautaire.
