Article L2344-4 of the French Labour Code

For establishments or undertakings located in one of the States mentioned in Article L. 2341-1, other than France, the members of the special negotiating body and the employee representatives on the European Works Council, set up in application of Article L. 2343-1, are elected or appointed in accordance with the rules or practices in force in these States.

Pour les établissements ou les entreprises implantés dans un des Etats mentionnés à l’article L. 2341-1, autre que la France, les membres du groupe spécial de négociation et les représentants des salariés au comité d’entreprise européen, mis en place en application de l’article L. 2343-1, sont élus ou désignés selon les règles ou usages en vigueur dans ces Etats.
