Article L235-3 of the French Commercial code

An action for nullity is extinguished when the cause of the nullity has ceased to exist on the day the court rules on the merits at first instance, unless the nullity is based on the unlawfulness of the corporate object.

L’action en nullité est éteinte lorsque la cause de la nullité a cessé d’exister le jour où le tribunal statue sur le fond en première instance, sauf si cette nullité est fondée sur l’illicéité de l’objet social.
