Article L2351-4 of the French Labour Code

Information shall mean information provided by the management body of the European Company to the body representing the employees on matters which either concern the European Company itself and any subsidiary or any establishment situated in another Member State, or which exceed the powers of the decision-making bodies situated in a Member State.

This information shall be provided in such a way as to enable the employees’ representatives to assess its possible impact and, where appropriate, to prepare consultations with the competent body of the SE.

Article L2351-4

On entend par information celle fournie par l’organe dirigeant de la société européenne à l’organe représentant les salariés sur les questions qui soit concernent la société européenne elle-même et toute filiale ou tout établissement situé dans un autre Etat membre, soit excèdent les pouvoirs des instances de décision situées dans un Etat membre.

Cette information se fait selon des modalités permettant aux représentants des salariés d’en évaluer l’incidence éventuelle et, le cas échéant, de préparer des consultations avec l’organe compétent de la société européenne.
