Article L2352-17 of the French Labour Code

If, in the course of negotiations, the parties decide to lay down participation arrangements, the agreement shall determine the content of these arrangements including, where applicable, the number of members of the administrative or supervisory body of the European Company which the employees are entitled to elect, appoint, recommend or oppose, the procedures to be followed for the employees to elect, appoint, recommend or oppose the appointment of these members, as well as their rights.

Si, au cours des négociations, les parties décident de fixer des modalités de participation, l’accord détermine la teneur de ces dispositions y compris, le cas échéant, le nombre de membres de l’organe d’administration ou de surveillance de la société européenne que les salariés ont le droit d’élire, de désigner, de recommander ou à la désignation desquels ils peuvent s’opposer, les procédures à suivre pour que les salariés puissent élire, désigner ou recommander ces membres ou s’opposer à leur désignation, ainsi que leurs droits.
