Article L2352-3 of the French Labour Code

Seats on the special negotiating body are allocated between the Member States in proportion to the number of employees in each of these States in relation to the workforce of the participating companies and subsidiaries or establishments concerned in all the Member States. Their number is fixed by decree of the Conseil d’Etat.

Following the distribution thus made, the number of employees that each member of the special negotiating body represents is determined for the purposes of the calculations and votes mentioned in Article L. 2352-13.

Les sièges au sein du groupe spécial de négociation sont répartis entre les Etats membres en proportion du nombre de salariés employés dans chacun de ces Etats par rapport aux effectifs des sociétés participantes et des filiales ou établissements concernés dans l’ensemble des Etats membres. Leur nombre est fixé par décret en Conseil d’Etat.

A l’issue de la répartition ainsi opérée, le nombre de salariés que chaque membre du groupe spécial de négociation représente est déterminé aux fins de procéder aux calculs et votes mentionnés à l’article L. 2352-13.
