Article L2362-4 of the French Labour Code

The managers of the legal entities and the natural persons participating in the formation of the European Cooperative Society shall invite the special negotiating body to meet and to that end shall inform the staff representatives and the managers of the establishments and subsidiaries concerned who, in the absence of staff representatives, shall inform the employees directly, of the identity of the participating legal entities and, where applicable, of the participating natural persons as well as the number of employees they employ.

Negotiations begin as soon as the special negotiating body is set up. They may continue for six months unless the parties decide, by mutual agreement, to extend these negotiations, the total duration of which may not exceed one year.

During this period, the special negotiation body is regularly informed about the process of creating the European Cooperative Society.

The time spent in meetings by the members of the special negotiation body shall be considered as working time and paid at the normal rate.

Les dirigeants des personnes morales et les personnes physiques participant à la constitution de la société coopérative européenne invitent le groupe spécial de négociation à se réunir et communiquent à cet effet aux représentants du personnel et aux dirigeants des établissements et filiales concernés qui, en l’absence de représentants du personnel, en informent directement les salariés, l’identité des personnes morales participantes et, le cas échéant, des personnes physiques participantes ainsi que le nombre de salariés qu’elles emploient.

Les négociations débutent dès que le groupe spécial de négociation est constitué. Elles peuvent se poursuivre pendant les six mois qui suivent sauf si les parties décident, d’un commun accord, de prolonger ces négociations dont la durée totale ne peut dépasser un an.

Durant cette période, le groupe spécial de négociation est régulièrement informé du processus de création de la société coopérative européenne.

Le temps passé en réunion par les membres du groupe spécial de négociation est considéré comme temps de travail et payé à l’échéance normale.
