Article L2411-22 of the French Labour Code

Dismissal of an employee representative may only take place with the authorisation of the labour inspector.

This authorisation is also required for :

1° An industrial tribunal member who has ceased his duties for less than six months;

2° An employee who is a candidate for the position of industrial tribunal as soon as the employer has received notification of the employee’s candidacy or when the employee proves that the employer was aware of the imminence of his candidacy, and for a period of three months from the appointment of the industrial tribunals by the administrative authority. The benefit of this protection may only be invoked by the candidate whose name appears on the list submitted.

Le licenciement du conseiller prud’homme ne peut intervenir qu’après autorisation de l’inspecteur du travail.

Cette autorisation est également requise pour :

1° Le conseiller prud’homme ayant cessé ses fonctions depuis moins de six mois ;

2° Le salarié candidat aux fonctions de conseiller prud’homme dès que l’employeur a reçu notification de la candidature du salarié ou lorsque le salarié fait la preuve que l’employeur a eu connaissance de l’imminence de sa candidature, et pendant une durée de trois mois à compter de la nomination des conseillers prud’hommes par l’autorité administrative. Le bénéfice de cette protection ne peut être invoqué que par le candidat dont le nom figure sur la liste déposée.
