Article L2411-3 of the French Labour Code

Trade union delegates may only be dismissed with the authorisation of the Labour Inspector.

This authorisation is also required for the dismissal of a former trade union delegate, during the twelve months following the date on which he ceased his duties, if he exercised these duties for at least one year.

It is also required when the letter from the trade union notifying the employer of the trade union delegate’s appointment has been received by the employer or when the employee has proved that the employer was aware of his imminent appointment as trade union delegate, before the employee was summoned to the interview prior to dismissal.

Le licenciement d’un délégué syndical ne peut intervenir qu’après autorisation de l’inspecteur du travail.

Cette autorisation est également requise pour le licenciement de l’ancien délégué syndical, durant les douze mois suivant la date de cessation de ses fonctions, s’il a exercé ces dernières pendant au moins un an.

Elle est également requise lorsque la lettre du syndicat notifiant à l’employeur la désignation du délégué syndical a été reçue par l’employeur ou lorsque le salarié a fait la preuve que l’employeur a eu connaissance de l’imminence de sa désignation comme délégué syndical, avant que le salarié ait été convoqué à l’entretien préalable au licenciement.
