Article L2411-4 of the French Labour Code

The dismissal of an employee appointed under articles L. 2232-23-1 and L. 2232-26 may only take place with the authorisation of the Labour Inspector.

Such authorisation is also required as soon as the employer becomes aware that the employee’s appointment is imminent.

The same applies to the dismissal of a former employee with a mandate during the twelve months following the date on which his mandate ended. In this case, if no agreement has been reached at the end of the negotiations for which the employee was appointed, the period of protection runs from the date of the end of these negotiations, as evidenced by a statement of disagreement.

Le licenciement d’un salarié mandaté au titre des articles L. 2232-23-1 et L. 2232-26 ne peut intervenir qu’après autorisation de l’inspecteur du travail.

Cette autorisation est également requise dès que l’employeur a connaissance de l’imminence de sa désignation.

Il en est de même pour le licenciement d’un ancien salarié mandaté durant les douze mois suivant la date à laquelle son mandat a pris fin. Dans ce cas, lorsque aucun accord n’a été conclu à l’issue de la négociation au titre de laquelle le salarié a été mandaté, le délai de protection court à compter de la date de la fin de cette négociation, matérialisée par un procès-verbal de désaccord.
