Article L2421-5 of the French General Code of Local Authorities

Rights of enjoyment that may be transferred by inheritance or by assignment are extinguished on the date of posting of the statement provided for in the last paragraph of article L. 2421-4, unless, on that date, the holder had had constructions carried out at his own expense, or was exploiting the parcel on which the extinguished right related, or was having it exploited by his spouse or by one of his descendants.

Holders of rights of enjoyment that are extinguished, either pursuant to this article, or pursuant to the second paragraph of article L. 2421-1, are entitled to compensation.

In addition, holders of a lifetime right of enjoyment who personally farm the land are entitled to receive the fruits and harvests of the current crop year.

Les droits de jouissance transmissibles par voie héréditaire ou par voie de cession sont éteints à la date de l’affichage de l’état prévu au dernier alinéa de l’article L. 2421-4, sauf si, à cette date, leur titulaire avait fait effectuer à ses frais des constructions, ou exploitait la parcelle sur laquelle portait le droit éteint, ou la faisait exploiter par son conjoint ou par un de ses descendants.

Les titulaires de droits de jouissance qui sont éteints, soit en application du présent article, soit en application du second alinéa de l’article L. 2421-1, ont droit à une indemnité.

En outre, les titulaires d’un droit de jouissance viager qui exploitent personnellement ont le droit de recueillir les fruits et récoltes de l’année culturale en cours.
